These Terms of Service ("Terms") govern your access to and use of the TestForge platform, website, and related services (collectively, the "Service") operated by TestForge ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
TestForge is an AI-powered testing platform that integrates with your GitHub repositories to automatically generate, execute, and manage tests for your codebase. The Service includes AI-driven code analysis, test generation, test execution via Playwright and other frameworks, automated fix suggestions, and a web-based dashboard for managing your testing workflows.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access to your account
- Keeping your account information up to date
4. Subscription and Billing
TestForge offers free and paid subscription plans. For paid plans:
- Payments are processed securely through Stripe. We do not store your full credit card details on our servers.
- Subscriptions renew automatically at the end of each billing cycle (monthly or annual) unless cancelled before the renewal date.
- You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of the next billing cycle.
- Refunds are available within 14 days of initial purchase for annual plans. Monthly plans are not eligible for refunds but will remain active until the end of the current billing period.
All paid plans include a 14-day free trial. No credit card is required to start a trial.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Upload or transmit malicious code, viruses, or harmful data
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to mine cryptocurrency or run unrelated compute workloads
- Resell, sublicense, or redistribute access to the Service without our permission
- Exceed your plan's usage limits through automated or programmatic means
6. Intellectual Property
Your Content. You retain all ownership rights to the code, tests, and other content you provide through the Service. By using the Service, you grant us a limited, non-exclusive license to access and process your content solely to provide the Service.
Generated Tests. Tests generated by TestForge belong to you. You may use, modify, and distribute generated tests without restriction.
Our Platform. The TestForge platform, including its software, design, branding, and documentation, is owned by TestForge and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or brand assets.
7. API Usage
If your plan includes API access, the following additional terms apply:
- API keys are confidential and must not be shared publicly
- Rate limits apply based on your subscription plan
- We reserve the right to throttle or suspend API access that degrades service quality for other users
- You must not use the API to build a competing product or service
8. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not guarantee that AI-generated tests will be free of errors, complete, or suitable for any particular purpose.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You acknowledge that AI-generated code should be reviewed before deployment to production environments.
9. Termination
You may cancel your account at any time through your account settings. Upon cancellation:
- Paid subscriptions remain active until the end of the current billing period
- Your data will be deleted within 30 days of account closure
- You may export your data before account deletion
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay outstanding fees.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
11. Changes to Terms
We may modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice on the platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
